AMAZING:TAU SIGNED PRECONTRACT WITH GUROVIC TO BE THE COACH OF THE TEAM!

Miodrag Raznatovic, the attorney at law from Belgrade, who represents Milan Gurovic, gave the explanation of Gurovic case. Tha lawyer said that Gurovic signed on the 6 th of August some kind of PRECONTRACT with Tau, where the main clause said, THAT CLAUSES FROM PRECONTRACT WILL BE FORWARDED TO THE MAIN DEFINITIVE CONTRACT, WHICH WILL BE SIGNED LATER, and after signing be sent to the ACB office. The final and definitive contract (as contractual parties named it in the precontract) has never been signed, and the player was free to sign for any other club. TAU could go to the Court and maybe acts against the player, because after the signed precontract, he refused to sign contract, and ask for some compensation for damage, but no way that they can consider the player under the contract with TAU. The teams in Spain and any other country, usually do not send the precontracts to league office, and TAU did the same. They did not send the precontract to ACB, because they knew that the contract is not valid. But, on the 16th of September (40 days after the signature of the player)when TAU recognized that player will not sign the definite contract, decided to send precontrct and try to find the way to secure the player or at least get some buy out fee. But, the most amazing in the whole case is MISTAKE made by Spanish club, and previous agent of the player. The precontract does not consist any clause that Gurovic has any obligation to TAU to play for the team. The big mistake was made, because they put the clause in the precontract that MILAN GUROVIC is obliged to BE THE COACH OF TAU for the season 2003 04. It s really difficult to beleive that that kind of the mistake could be made, and I was schoked reading the precontract (sent by TAU to Yugoslavia), but it really happened. Most likely the person who did the precontract, used the example of some previous precontract for the coach, and did not change all the precontracts clauses properly. Funny but very usefull for the player. This let say PLAYERS COACHES contract between Gurovic and Tau, is going to FIBA to verify situation and most likely easily issue LOC for the player to play for NIS Vojvodina. The player signed precontract with NIS Vojvodina on the 30th of June 2003, and final contract in original after the European Championship in Sweden.
